EU-U.S. Data Privacy Framework to encourage trans-Atlantic data flows
It's been a month since the European Commission began the process to adopt an adequate decision for the EU-U.S. Data Privacy Framework, which will encourage transatlantic data flows and address the issues raised by the Court of Justice of the EU in its Schrems II decision from July 2020.
The draft adequacy decision proposal comes after President Biden signed an Executive Order on October 7, 2022, which establishes new, legally binding safeguards to address the issues raised. These safeguards include:
- Restricting US intelligence agencies' access to data
- Creating an independent, impartial redress mechanism to handle and resolve complaints from Europeans about the collection of their personal information.
